Hon. 0. C. Moody, presiding. At the convening of court yesterday morning the case of Daniel Regan was taken up, and after argument and charge of the court the jury retired.

After due deliberation they came in with a verdict of guilty. The next case was that of some one (we have his name, written by a prom-incut attorney, before uir, and if there is a man In the world cau tell what it is we should like to lie introduced to him) for selling liquor without a gov. eminent permit, in the saloon on Lee street that was at one time run by Charley Cordero. The defense was that he was selling under Cordero's license. The Jury was sent out, and at the adjournment had not come in.

A motion was made by Col. Parker for a new trial in the ease of John McDonald and Fritz Stark, who had been tried and found guilty at the August term 1879, nt Rapid City, of robbing the coach, on which Tom Hooper and Frank Abbott were passengers, and on which occasion they were relieved of their watches and their cash. During the same term of court Chas. Owens was convicted of the larceny of two horses from W. M.

Ward, and sentenced to three and a half years in the penitentiary. During the same term also Fran'k Harris was convicted of the larceny of some horseR, and sent up. After the conviction of Harris, Thos. Harvey, the lawyer who had defended him, as also Owens, became satisfied that McDonald and Stark were innocent of the stage robbery, and that Owens was innocent ot the crime of which he was convicted, and started in to get Harris to make a statement of the whole affair, and thus clear inno cent men who were then awaiting sen. tencc, and at lat was fortunate enough to get him to make the following slate, ment, on the strength of which the prisoners McDonald and Stark were not sentenced, but a motion for a new trial was continued to the present term: Statement of Frank Harris: We, 1 A J.

Johnnie burned the stamps there In the, morning. Wc laid outside of Custer City for two or three days, and went Into town at night to get grub. We made arrangements with French Hilly to gel us horses and meet cs at a spring about two miles from Custer City. He brought two horses, ft black and a dun, to us about midnight. I rode the dun and Johnnie rode the We gave Billy the little revolver and left our horses, a brow and a sorrel, there, which Billy said he would look after and take care of until we came baek.

Barton Alonzo, a soldier who is stationed at Camp Robinson, testified that Lame Johnnie went to a shoemaker In Cheyenne, wanting a pair of boots made, and had his feet measured for that purpose, but as one of them required a numlicr 6 and the other a number 4, the shoemaker was not willing to make them unless a deposit was made beforehand on account of the difference in the size of them making them unsalable. Lame Johnnie then gave him a si her watch and left the shop. The boots were made and taken away, and the watch left in soak for them. This soldier saw the watch, redeemed and took it with him, and produced it in court. The watch was identified by Frank Abbott as the one taken from him on the night in question.

This corroboration of Harris' statement virtually sets at rest theinnocence of McDonald and Stark. This morning the motion will ugain come up, and we have no doubt a new trial will be granted by the court, and then we presume the next thing will be a nolle prosequi entered by the prosecuting attorney, and the prisoners discharged. If Harris' Atatemcnt is H-uc in this part, why not in that part of it which refers to French Billy bringing them two horses to where they were camped at a spring two miles from Custer City From (he statement of Harris, he and Lame Johnnie rode off on the horses he brought them, and he (Biily) was to look after those they left there turned out loose. Masquerade Ball. The masquerade ball last evening at Wertheimer's hall under the manage-ment of the ladies of the Episcopal so-ciety was without a question the affair of the season. This being the last en tertaiumcnt of the season, (lent ap. preaching,) the management were determined to give the best last, and that they fully succeeded can be proven by every person present. The hall was filled uncomfortably full with mostly maskers, and owing to the lateness of the hour we cannot give in detail characters and by whom represented.

Every nationality on the face of the earth was represented, and in most cases the disguises were complete. Xo. 50 drew the ring cake, held by County Treasurer Xeill. We were tin able to learn the amount made by the entertainment, but the fact that the ladies were in good humor is proof positive that the profits were in excess of expectations. In short, it was in every fense of the word a success.

The facilities possessed by our city for the development of the iron industry are well known, and begin to be appreciated as the glare of numerous furnaces which nightly illuminate the skies fully attests. After the passengers were aone through the driver asked for the spring that held the candle he said he wanted to put it back in its place; Moore said never mind, he would take care of it Then Moore ordered him to pitch off the mail sacks, which ho did; the passengers were then ordered back into the coach, and the driver ordered to drive on.
